1.- Acceptance of the general conditions of use and access to the website.

By contracting the services of visitando.com, Users accept these General Conditions of Use, which define the rights and obligations of VISITANDDO.COM and Users within the framework of the Website.

These are the General Conditions of Use applicable to the use of the Website (without prejudice to the fact that for certain services there may be specific conditions) and to the contracting of services and they replace any other conditions, unless previously agreed in writing between VISITANDDO.COM and the User.

Users are not required to register in order to access the Website. However, in order to contract the services offered by VISITANDDO.COM, payment by credit card and identification of the purchaser will be required. In some cases, by express necessity of the activity, also the names and data of all participants, such as for the visit of the Alhambra in Granada or the ferries that cross the Strait of Gibraltar to Tangier.

2.- Purpose of the website

VISITANDDO.COM has developed this website to offer users a booking service for activities, transfers, excursions and guided tours in the area of influence of the Costa del Sol.

Likewise, VISITANDDO.COM offers through the Website a pick-up and transfer service that allows Users to have a private vehicle to pick them up and transfer them from one point to another, within the destination city in which the User is located. Mainly between the airport and hotels in the area, or vice versa.

Therefore, VISITANDDO.COM IS LIMITED EXCLUSIVELY TO OFFER THROUGH THE WEBSITE A SERVICE OF ACTIVITIES, EXCURSIONS, GUIDED TOURS AND TRANSFERS, IN THE COSTA DEL SOL, WHICH ARE EXECUTED DIRECTLY BY RIOS TRAVEL, wholesale agency, operator of Excursions & Transfers in the Costa del Sol.

3.- Booking on VISITANDDO.COM and registration on the website

In order to make reservations through the Website, Users will have to provide their personal details (name, surname, e-mail, telephone and mobile), or if applicable, the details of the person on behalf of whom the activity or transfer is being reserved, so that VISITANDDO.COM can make the reservation requested by the User.

By virtue of these General Conditions of Use, Users declare to provide true, accurate, current and complete information about their identity, or if applicable about the person on behalf of whom the activity or transfer is booked. In this sense, Users shall be responsible for the accuracy of the data provided to VISITANDDO.COM and for any consequences that may arise from errors in the information provided.

In accordance with the above, Users must immediately notify VISITANDDO.COM by e-mail booking@www.visitanddo.com., of any improper use of their User name and/or password, due to circumstances such as theft, loss or unauthorised access to them, so that VISITANDDO.COM can proceed to cancel or block and/or disable them as soon as it becomes aware of the improper use and purchase of services. As long as such facts are not communicated, VISITANDDO.COM shall be exempt from any liability that may arise from the misuse of user names or passwords by unauthorised third parties.

By accepting these General Conditions of Use, the User declares that he/she is over 18 years of age and has full capacity to understand and accept the contents of these Conditions. In the event that the user is under 18 years of age, he/she will need the effective consent of his/her parents, guardians or legal representatives for the acceptance of the provisions of these General Conditions. VISITANDDO.COM warns you that it will not assume any type of responsibility in the event that the User contracts the services of VISITANDDO.COM in breach of the provisions of the previous paragraphs.

4.- Specific conditions regarding the booking of activities and excursions.

The reservations made by each User through the Website are subject to the specific conditions applicable to each activity, excursion or guided tour. The User will be able to find these conditions in the description of each of these services, as well as in the confirmation email sent by VISITANDDO.COM once the booking has been made.

4.1.- General conditions applicable to all reservations.

In general, the booking of activities, excursions and guided tours promoted by VISITANDDO.COM through the Website is subject to the following conditions:

The dates and times of the activities, excursions and guided tours published on the Website have been pre-established by the Providers and cannot be modified in any way. Users may modify the details of their reservations whenever the conditions of the activity, excursion and/or guided tour allow them to do so. In order to make this modification, the User will have to click on the link found in the booking confirmation email sent by VISITANDDO.COM or send a request directly to booking@www.visitanddo.com.

The minimum time in advance for each booking varies depending on the activity, excursion and/or guided tour you wish to book. This aspect in particular can be seen on the activity's own page on the Website. VISITANDDO.COM informs you that it is not possible to book an activity with less advance notice than that indicated on the corresponding activity sheet.

To book an activity, excursion or guided tour privately, please contact VISITANDDO.COM by sending an email to booking@Visitanddo.com . The reservations made by each User through the Website are subject to the specific conditions applicable to each activity, excursion or guided tour. The User will be able to find these conditions on the description page of the Website for each of these services, as well as in the confirmation email sent to him/her by VISITANDDO.COM once the booking has been made.

4.2.- Specific conditions related to the information of the activity, excursion and/or guided tour booked.

The duration and all the necessary information for the enjoyment of the activity, excursion and/or guided tour booked is detailed in the description of each service. On the Website, as well as in the confirmation email sent to you by VISITANDDO.COM, the meeting point, the date, the time the bus will be available, with a margin of plus/minus 15 minutes, once the booking has been made.

In the confirmation email, in addition to providing all the information about the service booked, VISITANDDO.COM will provide the User with a voucher or voucher for the service booked so that the User can present it to the bus or minibus guide or the driver, prior to the start of the activity.

It is essential that Users are punctual and present themselves at the meeting point at the time and date indicated on their voucher, as all activities, excursions and guided tours are scheduled to start at a specific time and it is not possible to change the start time.

If, once at the destination, Users have any questions regarding the service booked, and in particular, regarding the meeting point of the activity, excursion or visit, Users may contact the Provider at the contact telephone number that appears on the voucher given to them by VISITANDDO.COM at the time of confirmation of the booking.

VISITANDDO.COM will not assume any responsibility if the User does not present the voucher to the guide/driver or in the activities where it is compulsory to carry a passport or identity card, and the User does not have it with him/her.

5.- Specific conditions for transfer bookings.

Each of the transfers offered by VISITANDDO.COM on the Website is subject to certain specific conditions, which Users may consult in the description of the transfer in question (located on the Website), or in the confirmation email sent to them by VISITANDDO.COM when they have made the reservation.

Without prejudice to the foregoing, Users should note the following points:

No extra charge for luggage: The prices on the VISITANDDO.COM website are final and there is no extra charge for luggage, as long as it fits in the vehicle booked. The price indicated on the website is per person.

Private service: The transfer service offered by VISITANDDO.COM is private, so the vehicle can only be used by Users who have contracted this service. In this case the prices are per vehicle.

Vehicle seating: The number of seats indicated on the Website is the maximum number of persons that can travel in the vehicle in addition to the driver. Please note that children occupy one seat as well as adults.

Pick-up time: For transfers originating at the airport, the User must indicate the scheduled arrival time of their flight. For transfers originating at a specific point at the destination, the User only has to indicate the time at which he/she wants to be picked up.

Modification of the reserved transfer: The User may modify the transfer provided that the conditions of the service that has been contracted allow it. In any case, the User will be able to make the corresponding modification through a link provided by VISITANDDO.COM in the service confirmation email.

Contact with the driver: In the email confirmation of the reservation made by the User, VISITANDDO.COM will detail the name, email and emergency number of the Transport Provider, in case the User does not find the driver or has any problem. The Shuttle service (Shuttle type) may make several stops on the contracted route to pick up or drop off passengers, although the maximum stipulated, except for operational exceptions, will be 8 stops on a journey.

6.- Economic conditions of contracting.

The booking of VISITANDDO.COM's services will be understood to be formalised once the Users have completed and accepted the booking form for the activity or transfer.

The prices will be those indicated by VISITANDDO.COM at the time of booking the activity or transfer chosen by the User. In general, VISITANDDO.COM will charge the full amount via the Website, through a secure payment gateway.

These prices are expressed in Euros (€), including taxes, and the total amount will be indicated at the time of the final confirmation of the contracting of the service. Payment may be made by credit or debit card (Visa or Mastercard) or any other means that may be implemented in the future. The possibility of payment by bank transfer is feasible by prior agreement once.

After contracting the reservation, Users will receive a confirmation email confirming the payment of the contracted service.

VISITANDDO.COM must be notified of any undue or fraudulent charge on the card used for the purchase or by email booking@www.visitanddo.com. as soon as possible so that VISITANDDO.COM can take the appropriate steps.

7.- Cancellation policy.

Each of the services promoted by VISITANDDO.COM on the Website (activities, excursions, guided tours and transfers) has a specific cancellation policy, which the User may consult in the description of the activity (on the Website), as well as in the confirmation email VISITANDDO.COM sends him/her once the booking has been made.

As a general rule, cancellations can be made up to 24 hours before the start of the service, except for the excursion to Granada with a visit to the Alhambra, which will be 3 days before the start of the service. If cancellation is made within these 3 days, the cancellation fee will be 100% of the price of the excursion. The Caminito del Rey, due to availability of tickets and timetables, can be cancelled without charge up to 48 hours before the start of the service. After this period, the cancellation fee will be 100% of the cost of the excursion.

In accordance with the above, and by accepting these general conditions of use, users declare that they have read and expressly accepted this cancellation policy and agree to the cancellation conditions of the activity or transfer booked through the website.

8.- Conduct on the website.

Users undertake to make lawful, diligent, honest and correct use of all information or content accessed through the Website, all in good faith and respecting at all times the law in force and these General Conditions of Use. In particular, but without limitation, Users shall not:

Communicating data that is not true, accurate, complete and/or up to date, or accessing the Website using the name, identification data or password of another User or impersonating any person or identity.

Use the Website for fraudulent purposes, or in connection with criminal offences or unlawful activities of any kind.

Introduce or disseminate computer viruses that may cause unauthorised alterations to the contents or systems comprising the Website.

Create a Profile or use the Website to use or re-use material that is unlawful, offensive, pornographic, abusive, abusive, indecent, defamatory, obscene or threatening in any way, or in violation of copyright, trademark or confidentiality, privacy or any other rights, or is otherwise injurious or objectionable to third parties.

For this purpose, VISITANDDO.COM will send an email to the User, when the activity or transfer has finished, so that he/she can evaluate the experience and the service provided by VISITANDDO.COM.

When VISITANDDO.COM receives the User's opinion and assessment, it will review it and publish it as soon as possible on the Website.

In any case, VISITANDDO.COM will publish the opinions of the Users provided that the content of the same is not illicit, obscene, abusive, threatening, defamatory, invades the privacy of third parties, or is otherwise objectionable to third parties, and provided that the content does not incorporate advertisements or links to other websites and/or that the opinion does not correspond to the rated service.

In particular, VISITANDDO.COM reserves the right not to publish opinions whose content may include the following expressions:

Discriminatory expressions: In no case will expressions that go against an individual and that violate the principles of the right to honour, to personal and family privacy, to one's own image and to the dignity of the person be allowed. Any type of discriminatory publication, whether for reasons of race, sex, religion, opinion, nationality, disability or any other personal or social circumstance, is prohibited.

Illegal activities: It is not permitted for content to promote illegal activities or to incorporate obscene or defamatory content.

Violence: Opinions are expressly prohibited from containing expressions that promote violence and/or include, without limitation, sexual violence or violence against animals and people.

Degrading content: Opinions or comments that are intimidating, threatening, degrading or in any way promote violence against a person or group are not permitted.

10.- Exclusion of liability.

By way of example, but not limited to, VISITANDDO.COM is not responsible for the following circumstances:

Cancellations made after the deadline by Users. VISITANDDO.COM will not be responsible under any circumstances for refunding the amounts paid by its Users when they have not complied with the cancellation period foreseen in the cancellation policy applicable to each service.

Delays or errors committed by the User to reach the meeting point of the activity, excursion or transfer booked. That is, VISITANDDO.COM will not assume any responsibility if the User misses the activity or transfer booked due to lack of punctuality and/or not being at the corresponding meeting point. The vehicles used have their stops, timetables and location monitored by GPS, which is recorded at all times.

Cases in which the guide/driver denies the User access to the corresponding activity, excursion and/or guided tour when the User does not have the corresponding voucher printed on paper and/or downloaded to his/her mobile phone.

Damage and theft affecting Users and their property during the enjoyment of the activities, excursions and guided tours and/or during the journey of the contracted transfer service.

For any injuries, damages and accidents that the User may suffer during the enjoyment of the activity, excursion, guided tour and/or transfer booked, as well as for any injuries, damages and accidents suffered by the User prior to the service and which have prevented him/her from enjoying it.

Cases in which the vehicle reserved for the transfer does not arrive at the pick-up point when the information provided by the User regarding the pick-up times and pick-up point is erroneous or misleading.

Of the loss of flights, trains, buses or any other means of transport, as a consequence of not having requested the transfer service with the period of time in advance recommended by VISITANDDO.COM. The User is solely responsible for knowing the departure time of his/her flight/train/bus and requesting the pick-up service in good time.

The loss of flights, trains, buses or any other means of transport, as a consequence of the visit, tour or excursion being extended for any reason. The weather conditions in which the Supplier carries out the activities, excursions and guided tours booked by the Users. Under no circumstances VISITANDDO.COM will be responsible for these circumstances, so the service will be understood to have been correctly provided. The Caminito del Rey or the Tangier excursion may be cancelled due to adverse weather conditions. In all cases, if the cancellation is made before departure, 100% of the ticket amount will be refunded. If the cancellation is made once the excursion has started, e.g. cancellation of the boats in the Strait of Gibraltar, we will try to refund the proportional part of the ferry, but there will be a cost for the kilometres travelled on the bus to Tarifa.

Likewise, VISITANDDO.COM does not grant any guarantee nor is it responsible, in any case, for damages of any nature that may arise from accessing or using the content or the Website. Among others, and by way of example but not limited to, VISITANDDO.COM is not responsible for the following circumstances:

Lack of availability, maintenance and effective functioning of the Website and/or its services or contents, as well as for damages of any nature that may be due to the lack of availability or continuity of the functioning of the Website.

Technical failures attributable to third parties or force majeure that prevent the correct functioning of the Website.

Cases of force majeure, understood as the failure, suspension or interruption of the services or use of the Website, as a result of the blocking of the Internet network, actions or omissions of third parties, or any other causes or circumstances beyond the control of VISITANDDO.COM that prevent the normal use of the Website.

The illicit, negligent, fraudulent use, contrary to the terms of these General Conditions of Use, or to good faith, of the Website, by the Users.

Intellectual property.

All rights to the content, design and source code of this Website and, in particular, including but not limited to, all rights to the photographs, images, text, logos, designs, trademarks, trade names, data included on the Website and any other intellectual and industrial property rights are owned by VISITANDDO.COM, or by third parties who have expressly authorised VISITANDDO.COM to use them on the Website.

Since the Website allows the publication of opinions, Users grant VISITANDDO.COM a universal, unrestricted and free licence for the use, distribution, public communication, adaptation and reproduction of said opinions. By means of the aforementioned licence VISITANDDO.COM may transform, adapt and, in short, use the opinions of the Users for advertising and promotional purposes on the websites and social networks owned by VISITANDDO.COM.

12.- Modifications

VISITANDDO.COM reserves the right to make as many modifications as it deems appropriate to these General Conditions of Use, in which case Users will be notified in advance. These modifications will be valid from the moment they are published on the Website.

13.- Safeguard clause.

All clauses or terms of these General Conditions of Use must be interpreted independently and autonomously, and the rest of the stipulations shall not be affected in the event that one of them has been declared null and void by a court ruling or final arbitration decision. The affected clause or clauses shall be replaced by another or others that preserve the effects pursued by the General Conditions of Use.

14.- Jurisdiction and applicable legislation.

These General Conditions of Use shall be governed by Spanish law. In the event of litigation regarding the interpretation, execution or validity of these General Conditions of Use, the Courts and Tribunals of the User shall have jurisdiction.
